Failure to use bicycle lane or path
(1) except as in paragraphs (2) & (3), it's a violation of this statute to operate a bike on any part of a roadway not a bike lane or bike path when a bike lane or bike path is adjacent to or near the roadway
(2) no one is required to comply with this statute unless the state or local authority with jurisdiction over the roadway finds, after public hearing, that the bicycle lane or bicycle path is suitable for safe bicycle use at reasonable rates of speed
(3) it's not a violation of this statute if a rider can safely move out bike lane or bike path when:
(a) overtaking or passing a bike, vehicle, or pedestrians in the bike lane or bike path & the bicyclist can't safely stay in the bike lane or bike path to do so
(b) preparing to turn left at an intersection or into a private road or driveway
(c) avoiding debris or other hazardous condition
(d) preparing to turn right when allowed
(e) going straight through an intersection where the bike lane or bike path is to right of the lane where motor vehicles must turn right
