Passing
Failure of slower driver to yield to overtaking vehicle
ORS > Vehicle Code > Passing > 811.425
(1) overtaken vehicle fails to move off of the main traveled portion of highway into an area sufficient for safe turnout when:
(a) overtaken vehicle is proceeding slower than a speed established as apparent evidence of 811.500 (unlawful stop or deceleration)
(b) overtaking vehicle is proceeding at a speed in conformity with 811.500 (Basic speed rule)
(c) the highway is a 2 directional, 2-lane highway AND
(d) there's no clear passing lane available to the overtaking vehicle.
Passing in a no passing zone
ORS > Vehicle Code > Passing > 811.420
(1) overtaken vehicle fails to move off of the main traveled portion of highway into an area sufficient for safe turnout when:
(3) statute doesn't apply when:
(a) turning left into/from alley, intersection, private road or driveway.
(b) an obstruction/condition exists necessitating driving to left of roadway center as long as driver yields to all vehicles within a distance constituting an immediate hazard & traveling in proper direction on unobstructed portion of roadway
Unsafe passing on the left
ORS > Vehicle Code > Passing > 811.410
(1) suspect violates any of the following requirements concerning overtaking & passing of vehicles:
(a) overtaking vehicle: must overtake any other vehicle going in the same direction to the left and at a safe distance. Must remain to the left until safely clear of the overtaken vehicle
(b) overtaken vehicle: must give way to the right to the overtaking vehicle and must not increase its speed until completely passed by the overtaking vehicle. Exception: when passing on right is permitted under 811.415 (unsafe passing on the right)
(c) The driver of a vehicle mustn't drive to the left side of the center of the roadway in overtaking and passing a vehicle proceeding in the same direction unless the left side is clearly visible and is free of oncoming traffic for a sufficient distance ahead to permit the overtaking and passing to be completed without interfering with the operation of a vehicle approaching from the opposite direction or a vehicle overtaken
(d) An overtaking vehicle shall return to an authorized lane of traffic as soon as practicable.
(2) This statute does not authorize driving to the left the road's center when prohibited under:
(b) passing in a no passing zone per 811.420 (passing in a no passing zone)
(c) The following requiring driving on the right:
Unsafe passing on the right

(1) it's a violation if a person:
(a) overtakes & passes on the right of a vehicle at any time not permitted under this statute
(b) overtakes & pass to the right of a vehicle by driving off of the paved part of the highway
(2) may overtake and pass on the right under any of the following:
(a)(A) the overtaken vehicle is making or signalling a left turn;
(B) the highway's paved portion is wide enough to let 2+ lanes of traffic to lawfully go in the same direction as the overtaking vehicle AND
(C) the roadway ahead of the overtaking vehicle is unobstructed for a distance sufficient enough to allow safe passage by the overtaking vehicle
(b) the overtaken vehicle is moving in the left lane of two or more clearly marked lanes used exclusively by vehicle traffic moving in the same direction as the overtaking driver.
(c) the overtaking vehicle is a bicycle that can safely make the passage under the existing conditions.
