Animals as Nuisances
Definition
- An animal other than livestock is a public nuisance if it:
- Bites, injures or attacks someone
- Chases vehicles or people
- Damages or destroys another's property
- Scatters garbage
- Trespasses on another's private property
- Disturbs anyone by frequent or prolonged noises
- Places a anyone in reasonable fear of imminent physical injury, when off its owner's or keeper's premises
- Injures or kills someone else's animal or fowl
- Is found to be in violation of 6.08.060 (Animals at Large)
- An animal isn't a nuisance if it bites a person or animal wrongfully assaulting it or trespassing on its owner’s premises after the animal is provoked
- Locate the animal and animal owner
- If owner cannot be determined or contacted and it can be housed in a shelter:
- Transport it to a shelter
- If wishing to cite owner, require LE contact prior to dog being released
Animals at Large
- Identify animal owner from RP or other identification (dog tags)
- If owner cannot be determined or contacted and it can be housed in a shelter:
- Transport it to a shelter
- If citing owner, require LE contact prior to animal being released
- Statutes:
Dog vs Livestock/Domestic Fowl
- Livestock are defined as: ratites, psittacines, horses, mules, jackasses, cattle, llamas, alpacas, sheep, goats, swine, domesticated fowl and any fur-bearing animal bred and maintained commercially or otherwise, within pens, cages and hutches
- Livestock owner
- Provide them a copy of ‘Livestock Owner’s Complaint’ form.
- This form must be included with your report
- Take photos of injure/killed property
- Get name, DOB, contact info, statement
- Dog owner
- Give the owner a ‘Dog Owner’s Rights’ form.
- This form must be included with you report to schedule a hearing if requested
- Get name, DOB, contact info, statement
- Owner can choose to: Have a hearing or release the dog to the shelter for adoption/euthanising
- Statutes
- Transport the dog(s) to the shelter for boarding.
- NOTE: Boarding fees will be paid by County if owner can’t afford them
- When a dog board hearing is scheduled, you will be asked to give testimony
- If the board determines the dog(s) can go home pending installation of a secure fence, you will be asked to inspect ensure fence will contain the dog prior to it being released from the shelter
Dog, Cat or Ferret Bites
- Attempt to located the animal
- Fill in the Deschutes County Sheriff Animal Bite Report
- Take photos of injuries
- If animal owner cannot be located it can be housed in a shelter:
- Transport animal to the shelter
- if citing owner, require LE contact prior to animal being released
- Animal owner must quarantine their dog 24x7 for ten (10) days, either at home or at a facility
- If cannot be done at home, fill in ‘Boarding During Quarantine’ form
- Provide animal owner with Quarantine FAQ
- Statutes
- Transport the animal to the designated shelter if required
Any reported bite, scratch, or possible exposure must be treated as valid and true and requires quarantine
