(1) with criminal negligence AND:

(a) in violation of a legal duty to provide care to another, the suspect withholds necessary & adequate food, physical care or medical attention from the cared for person OR

(b) having assumed permanent or temporary care, custody or responsibility for the supervision of another, the suspect withholds necessary & adequate food, physical care or medical attention from the cared for person
